I just received a hpd violation. What should I do?
You should correct the condition and then certify, either by mail or by using eCertification, that the violations were corrected within the required time period specified on the Notice of Violation. You can also seek a postponement for the correction of some violations. What could happen if I do not correct a violation or if I do not notify HPD of the correction?
· All violations have civil penalties associated with failing to correct. HPD could seek enforcement of those civil penalties in Housing Court through the Housing Litigation Division.
· HPD may seek to correct the correction condition through the Emergency Repair Program and will bill the property owner for the cost of the emergency repair plus related fees.
· Open violations may trigger enhanced enforcement by HPD, through programs created to identify buildings in distress. These programs focus inspection and other HPD resources on your property and may lead to the issuance of Orders.
· The inspection may be counted as an inspection leading to or resulting in a fee of $200. HPD began implementing Local Law 65 on August 20, 2015 as follows: If the department has performed two or more complaint-based inspections in the same dwelling unit within a twelve-month period, (B) each such inspection has resulted in the issuance of a hazardous or immediately hazardous violation, and (C) not all such violations have been certified as corrected pursuant to this section, the department may impose an inspection fee of two hundred dollars for the third and for each subsequent complaint-based inspection that it performs in such dwelling unit within the same twelve-month period that results in the issuance of a hazardous or immediately hazardous violation, provided that the department may by rule increase the fee for inspections performed during the period of October first through May thirty-first. All fees are billed through the Department of Finance and may become tax liens if not paid within the required period.
I cannot find the original certification document, I received a Preliminary Notice and wish to certify or I wish to certify some violations now and others at a later time. How can I certify correction?
In response to any of these situations, use the appropriate form provided below to certify correction or you can use eCertification (for non-lead and non-mold violations).
· Certification of Correction of Violations/Failures (non-lead, non-heat violations): Use this form when all violations on a Notice of Violation cannot be certified at one time or you do not have the original Notice of Violation. Include the original NOV ID, the violation number and all other information required about who completed the repair. Sign the form, and have your signature notarized. The form must be returned to the Borough Service Center in which the building is located.
· Notice of Correction of Violation—Heat: Use this form for Heat and Hot Water violations
· Certification of Correction of Violations—Lead-Based Paint: Use this form for Lead-Based Paint Violations
· Certification of Correction of Violations – Mold Violations (Class B or Class C): Use this form for Class B or Class C Mold Violations.
· Certification of Correction of Violations – Mold Violations for Buildings with under 10 units (all class violations) or 10 Units or More (Class A Violation): Use this form for buildings with under 10 units (all class violations) or 10 units or more (Class A violations).
· Certification of Correction of Violations—Reissuance: Use this form for Reissued violations.
· Certification of Correction of Failure: Use this form for Housing Quality Standards failures where there is no related Housing Code violation.
You may also request extra time to correct Lead-Based Paint Violations, or, in the case of a presumed lead-based paint violation (Order #616), you may contest the violation using XRF testing or, in certain cases, paint chip sampling.

I don't understand how to correct the hpd violation that was issued. What can I do?
I am not receiving the Notices of hpd Violations even though I own the building. Why not?
Notices of Violation (NOVs) are mailed to the last validly registered owner’s managing agent. IfYou must submit a new Property Registration in order to change the address to which NOVs are being mailed.
I have hpd violations on my building that are no longer eligible for certification. How can I clear them?
After the certification deadline has passed, building owners may file a Dismissal Request form with their Borough Service Center for a fee or seek a Violation Reissuance, which is a free certification program. The clearance of lead-based paint violations has additional requirements. Where to Place HPD Signs and Notices:
Once you've received your sign, you'll need to make sure each one is put in the right location. You can do this by studying the Housing Maintenance Code. Here are a few examples for quick reference:
• Floor Signs – Every floor needs to have a floor sign, with each floor appropriately numbered.
• Certificate of Inspection – Your 6 X 9 certificate of inspection visit card should be near the mailbox in a frame that can accommodate it.
• Boiler Room – The boiler room signs should be both in the lobby and on the boiler room door.
• Fire Safety Sign – Any fire safety signs should be easy to see near the mailbox or entrance.
• Janitor Sign – The superintendent's information should be at the entrance.
• Smoke Detector Sign – The smoke detector HPD sign should be near the mailbox.
• HPD Registration Number Sign – The serial number sign should be at the entryway or vestibule of the building.
• Gas Leak Notice – Information about what to do in case of a gas leak must be posted in a common area of the building.

Registration Number Sign: Property owners of residential multiple family dwellings (3+ residential units) or private dwellings where neither the owner nor the owner’s immediate family reside are required to register annually with HPD. Property owners must also register with HPD when a new owner takes over the property or when information on the registration form changes. Property owners will be billed $13 for each registration NYC Department of Finance and must pay the amount owed.
Gas Leak Notice: Property owners of a dwelling are required to provide tenants with a notice regarding procedures that should be followed when a gas leak is suspected. The information must be provided by: delivering such notice to each tenant and prospective tenant of such dwelling (all tenant-occupied units, including 1- and 2- family homes) with the lease or lease renewal form for such tenant or prospective tenant AND posting and maintaining a notice in a common area of the building. The required format for the sign is described in Section 12-11 of Chapter 12 of Title 28 of the Rules of the City of New York. Section 12-12.1 of Chapter 12 of Title 28 of the Rules of the City of New York describes conditions under which a combined notice may be used, combining notice of suspected gas leak procedures with notice for smoke detectors and carbon monoxide detectors.
Certificate of Inspection with Frame: The owner should provide a frame that is properly able to accommodate a 6" x 9" inspection visit card. The frame should be posted 48-62 inches above the floor. If a mailbox exists, the frame should be posted at or near the mailbox. If there is no mailbox in the vestibule, the owner should select a suitable accessible location in the vestibule or entrance way of the building for the frame. The HPD inspector who visits the premises will provide the inspection card. If the top portion of the card is not completed, the owner must fill in top portion of card.
Garbage Collection: If there is no 24-hour dumbwaiter service an owner must post a sign in the building lobby indicating the current hours and method of garbage collection. The sign should be enclosed in plastic or in a frame to prevent vandalism or tampering.
Key to Boiler Room: An owner must post the name and location of the person with the key to the boiler room on notices approved by HPD. One notice should be posted conspicuously in the lobby and another should be posted on the entrance door of the boiler room.
Floor Number Signs: Owner of the building or Dwelling must post a sign on each floor indicating the floor number on each floor.
Street Number on Dwelling: The owner of the property must maintain a street number on the front of the building. The street number must be visible from the sidewalk.
Janitor Name Sign: Place a sign right by the entrance or mailbox with Janitor/Superintendent’s or house keeper with their address, apartment number and telephone number.
Smoke Detecting Device Notice: The owner of Class A multi dwelling is required to post a Smoke Detector Notice Sign in a specific form which is approved by HPD and Install it near the mail boxes. The owner may instead choose to post a combined notice for Smoke and Carbon Monoxide Detecting Devices and Gas leak Procedures.
Carbon Monoxide Detecting Device Notice: The owner of the property must post a Carbon Monoxide Detecting Device notice sign in a form approved by hpd in common area near the building entrance.
Housing Information Guide Signs: The owner of the property must post a notice about the availability of the housing information guide for tenants and owners in a lobby near the mailboxes are located.
Serial Number Signage: After registration of your dwelling with HPD, you will get a serial number of the dwelling. The property owner must post a sign in the main entrance of the building hall. If you have two entrances, then we recommend posting another HPD building serial number sign on the other entrance hallway.
WHAT ARE HPD REQUIRED SIGNS ?
Certification of Inspection 6x9 frame: This is a required frame. This is one of the most essential documents related to your property that you’ll be required to post above your mailbox. If your building does not have a mailbox, you can display it on the main entrance door or pick a suitable location where the certificate is visible to everyone. The dimensions of the framed certificate must be 6 inches by 9 inches. Your HPD inspector will provide you with the certificate once the inspection is complete. Section of the Law: MDL § 329
Boiler room information sign: This is a required sign if you have a boiler room. One sign need to be put in the lobby and the other sign in the entrance to the boiler room. Place the boiler room information sign in your property’s lobby. It will display the contact details (name and phone number) and the location of the person having the boiler room keys. You can also place the same sign on the entry door of the boiler room.

Janitor/superintendent sign: This is a required sign. Place a sign indicating the contact details (name, address, and phone number) of the janitor in-charge or superintendent on each floor. Street number sign: This is a required sign. Place a sign outside your building displaying street number. The owner must post and maintain a street number on the front of building. The street number must be visible from the sidewalk.Section of the Law: HMC § 27-2049
Serial number sign: This is a required sign. All not owner occupied signs need to have this sign in the building. Please note non owner occupied sign need to be register with HPD.you are required to showcase your building’s serial number as provided by HPD in the main entry hall on the building. This sign will also include the complete address of your building and the contact details of the janitor/superintendent. The serial number sign is a mix of the street number and janitor sign. A sign containing the serial number assigned to the building by HPD should be posted in the building’s entrance hall. The sign should also include the building’s street address, and information about the superintendent, janitor, or housekeeper of the building. How do I register with HPD?
HPD offers registration through the online platform Online Registration System. Please note these forms have to be printed and mailed (not submitted online). In addition to filing paperwork, the $13 registration fee must be paid through the Department of Finance. You will see this on your Statement of Account, and can link to the DOF for payment directly from the Online Registration System.

What is NYC Smoke Policy Law (Local Law 147) ?
General Information In August 2018, New York City passed Local Law 147, which requires residential buildings with three or more residential units to create a policy on smoking and to share or disclose it with current and future tenants.NYC Local Law 147 will help protect New Yorkers from the dangers of secondhand smoke.
How to Comply What does this law require?
The law requires that owners of buildings with three or more residential units:
· Create a policy on smoking and share it with current and future tenants.
· Share where smoking is and is not allowed on the property, including all indoor and outdoor
locations. (The Smoke-Free Air Act bans smoking tobacco or non-tobacco products and using e cigarettes in common indoor areas.)
· Provide an annual notification of the policy on smoking to tenants- recommended with lease renewal.
· Provide a notice to all tenants if the policy on smoking changes
· Post Policy – In lobby
The law does not require housing to be smoke-free.
What does the new law requiring NYC apartment buildings ? No smoking law for NYC apartments is in effect !!
The Local Law 147, goes into effect Aug. 28 and mandates that all multi-dwelling properties outline and clearly post a smoking policy for its tenants. Although the law does not force landlords and boards to make their buildings smoke-free — tobacco use-Smoking in common areas is already prohibited by city law – NYC Department of health.
The Local Law 147 requires owner to have a written policy that states in what parts of a building smoking is permitted or prohibited, including all common outdoor areas, like rooftops, balconies and patios. The policy must be given to all tenants and owners and publicly displayed in the building. The law simply requires the owner/board to adopt a policy and to disclose that policy to all residents and potential residents.
The penalties for violations are between $100 and $400 for a first violation, between $500 and $1,000 for a second violation in a period of twelve months, and between $1,000 and $2,000 for a third, and subsequent violations in a period of twelve months.

What Are the codes that apply to this law ?
§ 25-81 Signs Identifying Owner, Managing Agent and Superintendent; Plans on Premises.
(a) (1) Identification signs for the purpose of identifying the owners and managing agents of multiple dwellings by the display of the serial number, shall comply with the applicable provisions of these rules.
(2) Identification signs for the purpose of identifying the superintendents, janitors or housekeepers of multiple dwellings, wherein such employees are required by the provisions of § 83, Multiple Dwelling Law, shall comply with the applicable provisions of these rules.
(b) Signs shall be constructed of metal, slow-burning plastic or other material approved by the Commissioner and shall be substantial, rigid and durable, in construction. Signs of cardboard or heavy paper may be used if such material is encased in strong metal, wood or plastic frames and is covered by clear plastic or glass not less than one-sixteenth inch in thickness and if provided with substantial backing. Signs shall be provided with means for fastening securely to the wall.
(c) (1) The following information shall appear on the sign, prescribed in paragraph (1) of subdivision (a) of this section, in four lines of lettering as indicated and in the order indicated:

(2) The following information shall appear on the sign, prescribed in paragraph (2) of subdivision (a) of this section, in four lines of lettering as indicated and in the order indicated:

(d) Telephone number of superintendent, janitor or housekeeper. The size of sign shall be sufficient to accommodate the required lettering and provide a margin of not less than one-fourth inch about the lettering on all sides.
(e) (1) Serial numbers, as specified in § 27-2104 shall be determined and assigned by the Department of Housing Preservation and Development. No serial number shall be changed or ordered without the approval of the Department of Housing Preservation and Development. The serial number shall be placed on the sign by the owner or his representative.
(2) The street address of the building consisting of the house number and the street shall be placed on each sign by the owner or his representative.
(3) The lettering shall be gothic type. The numbers composing the serial number shall be not less than one-half inch in height. The letters forming "Department of Housing Preservation and Development" and the street address shall not be less than one-fourth inch in height. All other letters shall be not less than three-sixteenth of an inch in height. Letters shall be of such width and whatever as will provide the greatest legibility.
(f) The lettering of signs, as specified in § 27-2104, shall be Gothic type and shall not be less than three-sixteenths of an inch in height. Letters shall be of such width and spacing as will provide the greatest legibility.
(g) The letters and the background of the sign shall be of contrasting colors.
(h) Signs shall be approved by the Department of Housing Preservation and Development before installation.
(i) Signs shall be located in the entrance hall at the main entrance to the building at the street floor. Signs shall be placed preferably over the mail boxes but, in any case, shall be conspicuously displayed in a prominent location in the entrance hall. Signs shall be located between 7 feet and 9 feet above the floor.
(j) Signs shall be fastened directly to the wall by screws or bolts in a rigid, substantial manner, or by other means as may be approved by the Department of Housing Preservation and Development.
(k) Sufficient lighting shall be provided so that the sign will be plainly legible at all times.
(1) Signs that are defaced, damaged or removed, shall be promptly repaired or replaced. Signs shall be maintained in such manner as to be easily read at all times.
§ 27-2104 Posting of serial number. An identification sign containing the dwelling serial number assigned by the department for the purpose of identifying the registered multiple dwelling and the owner, managing agent, and agent designated by the owner for the collection of rental
payments if different from the managing agent, shall be posted in every multiple dwelling in the manner and location prescribed by the department.

Smoking or using electronic cigarettes is prohibited in common indoor areas of buildings with three or more residential units. Common indoor areas of residential buildings include:

In all common indoor areas of the building, building owners must display either:

DID HPD Finalizes Rules Concerning Gas Leak Notices, Procedures ?
HPD officially adopted amendments to Administrative Code Section 27-2005, which governs procedures during suspected gas leaks and recordkeeping for smoke detectors and carbon monoxide alarms. The amendments and finalizing the proposed rule, HPD has formally adopted the requirements of Local Law 153 of 2016, the law that requires owners to notify residential tenants about proper procedures to follow in the event of a suspected gas leak.
The law itself became effective as of June 4, 2017, and HPD’s new rules went into effect on Oct. 18 2017

(2) Fire safety guides. The owner of a building or part thereof subject to this section shall prepare a fire safety guide and distribute such guide to the occupants thereof in compliance with the requirements of FC408.9 and R408-02(c). The owner of a building or part thereof subject to this section shall prepare, post and maintain fire safety notices in compliance with the requirements of FC408.9 and R408-02(d).

You can input your building information on our HPD signs by using a BLACK SHARPIE or a black permanent marker and write with all capital letters. Then, if your super or any other building contact information changes, you can erase the information by using a thinner and write the new information in the same manner you wrote the first information. We do not print your building specific information on the signs.
New York City landlords are required to post the following signs and notices in their buildings:

Basically, you are not required to have the yellow note posted. You are required to have the frame itself and then when the HPD inspector drops by the building for one reason or another, they will provide this yellow note. You do not need to order HPD inspection in order for them to post the yellow note. They just require the building owner to have the inspection frame on the wall, so that they have a place to put the yellow inspection card. These cards are not being sold to the public - they are given by the HPD inspectors. The HPD requires you to have certain signs hanging on the walls at all times, as well. There is a new law for Outlet Covers in Public Areas by HPD what is it?Effective September 3rd, 2015, Local Law 39 of 2015 requires standard 125 Volt 15-20 ampere electrical outlets that are present in the public areas of residential buildings with three or more units to have those electrical outlets protected by means of caps, covers or other safety devices over the receptacle openings. Electrical outlets in areas used exclusively for mechanical equipment or storage are exempt from this requirement.
If the electrical outlets installed are listed as tamper resistant in accordance with the New York City Electrical Code, covers or caps are not required. Tamper resistant outlets should be readily identifiable as they commonly have spring loaded inserts within the slots of the receptacle which must be depressed simultaneously to allow entry as would be typical when inserting a two or three pronged electrical appliance plug.
A Class A violation will be issued for failure to comply with this requirement. Once issued, the violation can be corrected by the installation of a cap, cover, safety device or by the replacement of the outlet itself with a tamper resistant electrical outlet.

An executor is considered “OTHER” ownership, as indicated in Section 2 of the Property Registration Form. Write “Executor” on the blank line and continue to Section 5, “Other than Individual Ownership” and Section 5A1 “Responsible Person #1” and complete all information. Section 6, 8, 10, 11 and 12 are all required.
My property is not a
residential building and does not require registration, but I have been billed
through the Department of Finance (DOF) for property registration. What
do I do?
If you believe you have received an improper property registration charge from DOF, contact HPD at firstname.lastname@example.org or (212) 863-7000. Provide the borough, property address and the current occupancy of the property. If HPD determines that registration is not required, HPD will advise DOF to remove the charge.
I continue to receive
registration notices from HPD even though I am no longer the owner. What
can I do?
Owners who have sold their property may request that HPD invalidate their last valid Property Registration Statement by properly completing and submitting (along with required documentation) an Application to Invalidate Registration.
My property does not appear
on HPD’s website. How do I register?
Contact HPD at email@example.com with the borough, address, block and lot of your property, as well as your contact information. HPD will research the property, add the information to its database and generate a Property Registration Form for you.
I do not see a fee on my
statement of account related to HPD Property Registration. Why not?
If the fee is not billed during the July Statement cycle, you will not be required to pay until the next cycle. This may happen if your property has a credit towards registration or the property is added as required to register to HPD records after the annual bill is sent.
Common mistakes to avoid when filing a Property Registration:
- Payment sent with the form to HPD: This will delay the processing of your form, as HPD must then send the payment over to the Department of Finance for application to the property charges.
- Not all addresses are provided to HPD: Residential and business addresses and telephone numbers must be provided for all the listed individuals in Section 5 and 6. The business address may be the same as the residential address (but must be fully written out in the boxes) if business related to the property is conducted at the residential address.
- Signatures in 11 and 12 do not match the individuals listed in the Agent (Section 6) and Owner (Section 5) sections of the form.
- Dates are not entered next to each signature.
- Managing agent business address is not a NYC address. The law requires the managing agent to have a NYC business address.
I already registered my rents. Why am I being asked to
register again by HPD?
Rent Registration is required by the New York State Homes and Community Renewal. That process is
different than New York City’s Annual Property Registration. Rent Regulated buildings must complete both processes.

Carbon Monoxide Law Compliance what is it?
Carbon monoxide (CO) is a highly toxic gas. It is the product of the incomplete combustion of fossil fuels such as oil, natural gas, gasoline, wood and coal. The major sources of carbon monoxide in homes and apartments are fossil fuel burning boilers, furnaces, water heaters, fireplaces and parking garages. CO is very dangerous because it is colorless, odorless, tasteless, and non-irritating. CO poisoning can be fatal. The warning signs of CO poisoning are headaches, dizziness, tiredness and nausea. If you feel that you are suffering from the effects of carbon monoxide poisoning or that your home may have a CO leak, immediately open all of the windows, remove yourself from your home and call the Fire Department.
New York City has laws in place to protect people from carbon monoxide poisoning. Both landlords and tenants have responsibilities to ensure that all New Yorkers are safe.
Residential owners are required to ensure that tenants are provided with carbon monoxide detectors under Local Law 75 of 2011. Private one- and two-family dwellings are also required to have carbon monoxide detectors installed. This 2011 law amended Local Law 7 of 2004, which required carbon monoxide detectors to be installed by November 1, 2004. The 2011 law additionally requires the replacement of all existing detectors, as their useful life expires, or by October 2012, whichever is later. Approved CO detectors must comply with UL 2034 of Underwriters Laboratories. For existing buildings, a CO detector can be battery-operated, or can plug into an electrical outlet as long as it has a battery back-up in case of power interruption. New buildings or substantially improved buildings must have detectors that are hard-wired to the building's electrical systems. The installation of a combination smoke alarm/CO detector is allowed.
Owners' responsibilities include:
- Provide and install at least one approved carbon monoxide detector within each dwelling unit. The carbon monoxide alarms must be installed within 15 feet of the primary entrance to each sleeping room. The alarm must also be equipped with an end-of-life alarm. This applies to all multiple dwellings and one- and two-family homes.
- File a Certificate of Satisfactory Installation with HPD within 10 days from the date of installation. You can file online or complete and submit the Form CO1 as directed. Click here to go to the application HPDOnline. When you enter the HPDOnline application, type in your building address. On the next screen, look for the left menu bar and click on the option Carbon Monoxide Certificate. Then proceed to complete the online Carbon Monoxide Detector Certificate of Installation. You must be validly registered with HPD in order to file this Certificate. In buildings with cooperative units, the managing agent for the cooperative owners of the building should be filing the form for all units in the building. In buildings with condominium units, the Board of Managers must file a form for the entire building.
- For Class A multiple dwellings, post a notice in a form approved by HPD in a common area informing occupants of Local Law 75 requirements. "A" units are dwellings used, as a rule, for permanent residences. The typical residential apartment is an "A" unit.
- Provide a notice in a form approved by HPD informing occupants of Local Law 75 requirements. This applies to non-owner occupied units in private one- and two-family homes.
- Provide written information regarding the testing and maintenance of carbon monoxide alarms, including general information concerning carbon monoxide poisoning and what to do if a carbon monoxide alarm goes off, to at least one adult occupant of each dwelling unit when the unit is installed. This applies to class "A" multiple dwellings and non-owner occupied units in one- and two-family homes.
- Keep all records relating to the installation and maintenance of carbon monoxide alarms and make them available upon request to the Department of Housing Preservation and Development (HPD), the Department of Buildings (DOB), the Fire Department and the Department of Health and Mental Hygiene (DOHMH).
- Keep and maintain the carbon monoxide alarms or systems in good repair. This applies to class "B" multiple dwellings. "B" units are dwellings used, as a rule, on a temporary basis. For example, single room occupancies are typically "B" units.
- Some units in buildings without fossil fuel burning furnaces or boilers may be exempt from filing a Certificate of Satisfactory Installation. You should review the Department of Buildings regulations on www.nyc.gov/buildings for more information on exemption. You must file an Affidavit of Exemption with HPD to request an exemption. If you are filing for a partial exemption, you have the option to modify the notice that should be posted in the building (see bullet 2 above). You should submit the modified posting that you wish to use with your exemption application for approval by the Department.
Tenants of Class A multiple dwellings and one- and two family dwellings are required to:
- Reimburse the building owner $25.00 for each carbon monoxide alarm that is newly installed or installed as a result of the occupant's failure to maintain the carbon monoxide alarm or where the carbon monoxide alarm has been lost or damaged by the occupant.
- Keep and maintain the carbon monoxide alarm in good repair.
- Test all carbon monoxide detectors at least once a month (all alarms have test buttons).v
- Replace batteries twice a year, in the spring and in the fall when clocks are changed for daylight savings time.
- Replace the battery immediately. An audible trouble signal will sound warning that the battery is low.
- Never paint over carbon monoxide detectors.

When must the Smoke detectors be installed?
All detectors must be installed by November 1, 2004. Under limited circumstances, the Department of Buildings’ borough offices may grant time extensions until June 30, 2005. Where should the CO detectors be installed?

CO detectors do not have to be installed on or near the ceiling. To ensure proper operation, do not install CO detectors next to bathrooms, which are sources of humidity, or near gas stoves, gas dryers, etc. Detectors should not be placed in areas where they are likely to be damaged by children or pets.
What are the penalties if an owner does not install a CO detector?
Failure to provide or maintain a CO detector is a class B violation. Civil penalties can range from $25 to $100 and $10 per day for each violation until the violation is certified as corrected. In addition, failure to provide proper notices to occupants or certification of installation is a class A violation which can carry civil penalties of up to $50.

Filing requirements: Filing is required when devices are changed according to the requirement timeframes or whenever broken/missing devices are replaced. You can file either by using HPDONLINE (no hard copy submission is required if you submit online) or by printing and properly completing (including a signature) the below forms. You must be validly registered with HPD in order to file this Certificate online or to submit a forms. In buildings with cooperative units, the managing agent for the cooperative owners of the building should be filing the form for all units in the building. In buildings with condominium units, the Board of Managers must file a form for the entire building.

Does HPD give Violation for building owner who do not have the heat On October 1st through May 31st.
Building owners are legally required to provide heat and hot water to their tenants. Hot water must be provided 365 days per year at a constant minimum temperature of 120 degrees Fahrenheit. Heat must be provided between October 1st and May 31st, i.e. "Heat Season," under the following conditions:
Day Between the hours of 6:00am and 10:00pm, if the outside temperature falls below 55 degrees, the inside temperature is required to be at least 68 degrees Fahrenheit.
Night Between the hours of 10:00pm and 6:00am, the inside temperature is required to be at least 62 degrees Fahrenheit.
What is the NEW York Heating Regulation- New York City Heating Regulations – Local Law 86 of 2017:
Beginning October 1, 2017, pursuant to Local Law 86 of 2017, the regulations regarding providing heat during the nighttime hours have changed. During the Heat Season (October 1 – May 31), property owners must maintain an indoor temperature of 62 degrees inside all apartments at all times.
The former outdoor temperature trigger of 40 degrees outdoors is no longer in play and heat will now always need to be provided. This is also a 7 degree difference inside, as the old regulations provided for the landlord to provide heat to 55 degrees inside when the temperature fell below 40 degrees outside.
If the inside temperature falls below 62 degrees, tenants may file a complaint about inadequate heat with 311. Please take necessary action to ensure that your heating system will be provide heat according to the law beginning October 1st. Daytime heat must still be provided at a minimum of 68 degrees once it is below 55 degrees outside and hot water must be still be maintained at 120 degrees.

New York City landlords are required to post the following signs and notices in their buildings:
- Certificate of inspection visits. Owners need to provide a frame that will accommodate a 6″ x 9″ inspection visit card, issued by the Housing Preservation & Development (HPD) inspector who visits the property. The frame should be between 48″ and 62″ above floor height, located at or near the mailbox (if present).
- Garbage collection notice. Display a tamper-proof sign with the current hours and method of garbage collection in the lobby. (Exception: Buildings with 24-hour dumbwaiter service are exempt.)
- Building floors. Identify the number of each floor with a sign, or paint the number directly on the wall.
- Street numbers. The front of the building must display the street number. This number must be visible from the sidewalk and properly maintained.
- Smoke detectors. Smoke detector requirements must be posted at or near mailboxes, using an HPD-approved form.
- Carbon monoxide detectors. Owners must also post HPD-approved notices with carbon monoxide monitor requirements in a common area.
- Housing information guide notice. Notify tenants about the availability of the New York City housing information guide by posting a notice near the mail delivery area.
- Service interruption. If making repairs or performing any work that will interrupt utilities for more than two hours, owners need to post a public notice at least 24 hours before the service interruption. (Update the sign, as required, and post the information in both English and Spanish.)
In addition, building owners need to post contact information for specific functions, including emergency contacts:
- Boiler room access. HPD requires owners to post the name and location of the person who has access to boiler room keys. One notice goes in the lobby; another belongs on the boiler room entrance.
- Janitor name/address. Owners must post a sign with the name of the janitor or housekeeper at the building entrance. The sign must include the person’s address, apartment number and telephone number.
- Disaster response signage. Residential buildings with any non-owner-occupied units must post a temporary notice with emergency contact information in the common area at the following times:
- Before a weather emergency (e.g., blizzard, tropical storm, etc.)
- After a natural disaster
- After learning that a utility outage will last longer than 24 hours
