Post Gas Leak Notice Law: HMC § 27-2005 (Local Law 153 of 2016)
Post Gas Leak Notice
Requirement for Property Owners
Property owners of residential dwellings in New York City are legally required to provide tenants with a notice explaining the procedures to follow if a gas leak is suspected. This requirement applies to all tenant-occupied units, including one- and two-family homes. The notice must be:
-
Delivered to each tenant and prospective tenant at the time of lease signing or lease renewal.
-
Posted and maintained in a common area of the building that is accessible and visible to tenants.
Required Format
The specific format of the gas leak notice is outlined in Section 12-11 of Chapter 12 of Title 28 of the Rules of the City of New York. The notice must provide clear, standardized instructions to ensure tenants know exactly what to do in the event of a suspected gas leak.
Combined Safety Notice Option
Under Section 12-12.1 of Chapter 12 of Title 28, property owners are permitted, in certain cases, to use a combined notice. This format allows one posting to cover multiple safety requirements:
-
Suspected gas leak procedures
-
Smoke detector requirements
-
Carbon monoxide detector requirements
This option reduces redundancy while ensuring tenants have all critical safety information in one place.
Legal Authority
The requirement for the Post Gas Leak Notice is based on the Housing Maintenance Code §27-2005, which obligates property owners to keep residential buildings in a safe and compliant condition. Failure to provide and maintain this notice can result in violations and penalties.
See the Post gas leak notice in the Required Signage section above.
